Penerapan Sanksi Pidana Tambahan Dipecat Dinas Militer Terhadap Pelaku Tindak Pidana Desersi (Studi Putusan Pengadilan Militer I-02 Medan Nomor 54-K/PM.I-02/AD/IV/2024)

Abstrak

 

Tindak pidana desersi merupakan suatu tindak pidana militer murni yang dilakukan oleh seorang prajurit karena bersifat melawan hukum dan bertentangan dengan Undang-Undang. Desersi merupakan perbuatan anggota Tentara Nasional Indonesia yang meninggalkan dinas tanpa izin terhadap atasannya. Perkara desersi diproses melalui sistem peradilan yang bersifat khusus yaitu peradilan militer. Pertimbangan hakim nantinya akan menentukan berat ringannya putusan terhadap anggota Tentara Nasional Indonesia yang melakukan tindak pidana desersi tersebut.Penelitian ini bersifat deskriptif dan metode pendekatan yang digunakan dalam penelitian ini adalah penelitian yuridis normatif serta dianalisis secara kualitatif. Pengaturan hukum tindak pidana militer desersi yang dilakukan oleh prajurit TNI diatur dalam Kitab Undang-Undang Hukum Pidana Militer (KUHPM) dan khusus tindak pidana militer desersi dalam putusan Nomor 54-K/PM.I-02/AD/IV/2024 diatur dalam Pasal 87 Ayat (1) ke-2 juncto Ayat (2) juncto Pasal 88 Ayat (1) ke-1 juncto Pasal 26 KUHPM juncto Pasal 190 Ayat (1) juncto Ayat (3) juncto Ayat (4) Undang-Undang RI Nomor 31 Tahun 1997. Penerapan sanksi hukum terhadap prajurit adalah pidana pokok : penjara selama 10 (sepuluh) bulan serta pidana tambahan : dipecat dari dinas militerpertimbangan hukum hakim menjatuhan pidana tambahan pemecatan dari dinas militer dalam putusan Nomor 54-K/PM.I-02/AD/IV/2024 adalah perbuatan terdakwa mencerminkan sifat terdakwa yang tidak baik dan tidak patuh lagi terhadap aturan hukum yang berlaku.

Abstract

 

The crime of desertion is a purely military crime committed by a soldier because it is against the law and contrary to the Law. Desertion is an act of a member of the Indonesian National Army who leaves the service without permission from his superiors. Desertion cases are processed through a special judicial system, namely military justice. The judge's consideration will later determine the severity of the verdict against the member of the Indonesian National Army who committed the crime of desertion. This research is descriptive and the approach method used in this research is normative legal research and is analyzed qualitatively. The legal provisions for the crime of military desertion committed by TNI soldiers are regulated in the Military Criminal Code (KUHPM) and specifically the crime of military desertion in decision Number 54-K/PM.I-02/AD/IV/2024 are regulated in Article 87 Paragraph (1) 2 in conjunction with Paragraph (2) in conjunction with Article 88 Paragraph (1) 1 in conjunction with Article 26 of the KUHPM in conjunction with Article 190 Paragraph (1) in conjunction with Paragraph (3) in conjunction with Paragraph (4) of the Republic of Indonesia Law Number 31 of 1997. The application of legal sanctions against soldiers is the main penalty: imprisonment for 10 (ten) months and additional penalties: dismissal from military service. The judge's legal considerations for imposing an additional penalty of dismissal from military service in decision Number 54-K/PM.I-02/AD/IV/2024 are that the defendant's actions reflect the defendant's bad character and disobedience to applicable legal regulations.
